The way employees of companies worldwide communicate has significantly altered due to the continuous improvement of digital communications technologies. Modern communication platforms like Microsoft Teams, Zoom, and Cisco WebEx have overtaken other options in enterprises for remote collaboration since the Covid-19 pandemic started. Additionally, there has been a significant boost in secure financial text message archiving using the following messaging apps: WhatsApp, WeChat, Signal, and Telegram.

Regulatory organizations like the SEC and FINRA have been prompted to revise current compliance rules and propose new regulations covering hybrid working models’ requirements by the rapid proliferation of digital communication technology in regulated enterprises. Regulators anticipated that the registered businesses would go further in their efforts to comply by utilizing more advanced digital communication technology.

Some organizations, however, need to continue to upgrade their monitoring and archiving systems for contemporary digital technology. The SEC continues to focus entirely on communication compliance, as seen by the recent broad statement by the SEC Director of Enforcement Division and the subsequent SEC sweep.

In a speech given in October 2021, Gurbir Grewal, the director of the SEC’s enforcement division, emphasized the need for proactive compliance in workplaces, the delivery of customer relationship summaries, or CRS, and Regulation Best Interest, or Reg BI. He also focused on some of the SEC’s most significant enforcement actions against well-known financial institutions that had been making the best of their efforts recently.

The SEC periodically sweeps to gather data on companies it suspects are struggling to comply with monitoring obligations like SMS archiving regulations. The sweeps may occasionally develop into formal regulatory inquiries depending on the facts and circumstances.
